Overview

NeuropsyConsulting provides independent neuropsychological consultation in civil, criminal, and administrative matters. Dr. Considine offers medical and legal record review, full neuropsychological examination, and expert opinion regarding the neurological, psychiatric, and non-medical contributions to an examinee's neurobehavioral presentation and symptom history. Opinions address the relationship between examination findings and the relevant legal or administrative question, including the intersection with applicable statute. All evaluations of adults age 18 and older.

Approach and standards

Evaluations are conducted in accordance with current professional and board standards. To protect test security and the validity of findings, third-party observation of the cognitive examination is not permitted, and raw test data and materials are released only to qualified licensed psychologists, consistent with published interorganizational position statements. Retaining counsel agrees to consult with Dr. Considine regarding any opposing requests bearing on how the evaluation is conducted. Dr. Considine does not participate in evaluations where test security is compromised by stipulation or court order, and reserves the right to recuse if security cannot be protected.

Civil and administrative matters

Common referral questions include personal injury and claimed cognitive damages; testamentary, contractual, and fiduciary capacity; guardianship and conservatorship; disability and fitness questions; and professional licensing and board matters. Dr. Considine accepts retention from both plaintiff and defense counsel.

Criminal matters

Common referral questions include competency to stand trial, mental state at the time of the offense, diminished capacity, capacity to waive Miranda rights, and mitigation at sentencing. Dr. Considine accepts retention from defense and prosecution, and by court appointment. He will consider court-appointed matters in which the Administrative Office of the Courts or the court has set a fee ceiling for subspecialty medical experts. Please raise this at the time of inquiry.

Engagement and fees

Forensic services are billed on an hourly basis for record review, examination, consultation, and report preparation, with separate rates for deposition and trial testimony. A non-refundable retainer is required to open a matter and is credited against fees and expenses. Fees are not contingent on the outcome of any litigation or settlement. The full retainer agreement and fee schedule are provided upon inquiry.
